The web pages available at twiangulate.com, and all linked pages ("Site"), are owned and operated by Pressflex LLC ("Twiangulate"), and are available for users ("You") under the Terms ("Terms") described below. You agree to these Terms by accessing the Site or using any part of the Site or Services. If You do not agree to the Terms, please discontinue use of the Site immediately.
Twiangulate reserves the right to change any of the Terms or any policies or guidelines governing the Service at any time and in its sole and absolute discretion. Any changes will be effective upon posting of the revisions on the twiangulate.com/terms. You are responsible for reviewing any applicable changes. Changes to referenced policies and guidelines may be posted without notice to You. YOUR CONTINUED USE OF THE SERVICE FOLLOWING APPLICATION PROVIDER'S POSTING OF ANY CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES OR MODIFICATIONS. IF YOU DO NOT AGREE TO ANY CHANGES TO THIS AGREEMENT, YOU MUST TERMINATE THIS AGREEMENT IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT.
Twiangulate may offer to provide certain services and content ("Services") to You. Services may include, but are not limited to, any search or content performed for You by Twiangulate. Twiangulate may change, suspend, or discontinue any of the Services on the site without notice to You.
Twiangulate allows You to link up Your Twitter account in order to use the Services. Upon linking up Your account, you allow Twiangulate to issue Twitter API calls through Your Twitter account. To unlink Your Twitter account from Twiangulate, You can do so in the “Connections” tab of Your Twitter account.
Twiangulate reserves the right to change any of the Services at any time and in its sole and absolute discretion.
Twiangulate may become unavailable from time to time. This may depend on Twitter’s availability, or on Site’s availability.
The Service is a venue for You to search for new Twitter users to follow. You hereby acknowledge and agree that the Site is not involved in the actual processing of following Twitter users. You shall indemnify and hold harmless Twiangulate in respect of all liability, losses, damages, costs or expenses howsoever caused, arising out of, or in connection with a breach of your obligations under this Agreement.
SITE, ITS OFFICERS, DIRECTORS, AGENTS, ADVISORS, AFFILIATES AND THIRD PARTY SERVICE PROVIDERS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF THIS AGREEMENT, THE PROVIDING OF SERVICES HEREUNDER, THE SALE OR PURCHASE OF ANY GOODS OR MERCHANDISE, YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICE, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE SERVICE, YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY OF THE MERCHANDISE, INFORMATION OR MATERIALS AVAILABLE ON THE SERVICE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
Site is not responsible for the content of search results. Site does not review Tweets or User data, and does not verify, endorse or otherwise take responsibility for the contents of any search results through Services.
Twiangulate may terminate or suspend You from using any and all Services and your Twiangulate account immediately with no notice to You and without cause. Upon termination of Your account, You will immediately lose the right to use the Services. If you wish to terminate your account with Twiangulate, you may discontinue use of the services and disallow Twiangulate's link with Your Twitter account in the connections tab in Your Twitter account settings.
During Your interactions with Twiangulate.com, Site may request certain information related to Your Twitter account and use of Site. If You provide such information to Site, Site may collect and store such personal information. Site may collect Your email addresses, request access to your Twitter account, and collect Your IP address. Site will collect information regarding your activities through the Service. Site will collect any comments you may send to Site and any information you may post to the Site. Site may also collect information through the use of Cookies (as defined below). Site may collect personal information when you: (1) link Your Twitter account with Twiangulate, (2) provide comments or submit a problem to Site, direct message Twiangulate's Twitter account, or mention @Twiangulate in a Tweet of Your own, (3) request information from Site and provide your name or return contact information, or (4) respond to special offers, contests or surveys. As part of the registration process, you may be asked to provide contact information and other personally identifying information. Providing some of the requested information is optional and Site will indicate what information is required and what information is optional. "Cookies" are data files that may be downloaded to your computer when you visit the Site and permit the Twiangulate server to identify your browser whenever you interact with the Site. Site uses cookies to recognize repeat visits by users of its Service and to collect information about its users' interactions with the Services. These cookies contain identification information that enables us to streamline your experiences using the Services. You may set your browser software to reject cookies, but you may not be able to optimize the features of the Services. In some cases, you may not be able to access Services if cookies are disabled.
As a part of the Services, Twiangulate provides links to web sites operated by third parties. Twiangulate is not responsible for the information collection or privacy practices or the content of those third party sites.
Site stores personally identifiable information obtained through registration securely and considers it part of the assets of its business. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, Site has put in place physical, electronic, and managerial procedures to safeguard and secure the information it collects online. However, data security is a constantly evolving art and science. You should consider any communication that you transmit to Site (such as data, questions or answers, comments, or suggestions) as non-confidential, and agree that Site will not be liable or responsible if information that belongs to you is intercepted and used by an unintended recipient.
Site uses reasonable efforts not to collect, use or disclose individually identifiable information from children under the age of 13. The Services are not targeted at children, and children may not use any of the Services.
This Agreement shall be governed in all respects by the laws of Delaware and the parties agree to submit to the non-exclusive jurisdiction of the Delaware courts. These Terms are the entire and exclusive agreement between Twiangulate and You regarding the Services (excluding any services for which you have a separate agreement with Twiangulate that is explicitly in addition or in place of these Terms).
